Terms of Service

1. Acceptance

By creating an account or using StudyDesign AI, you agree to these Terms of Service. If you do not agree, do not use the service. These terms form a binding agreement between you and the operator of StudyDesign AI.

2. The service

StudyDesign AI provides an AI-powered tutoring platform for VCE students. Features include an AI tutor, practice test generation, flashcards, voice mode, and study scheduling based on the VCAA timetable.

StudyDesign AI is an independent product. It is not affiliated with, endorsed by, or officially connected to the Victorian Curriculum and Assessment Authority (VCAA). VCAA study designs are used as reference material only.

3. Accounts

  • You must provide a valid email address and keep your login credentials secure.
  • You are responsible for all activity on your account.
  • You must be at least 13 years old to create an account. If you are under 18, a parent or guardian should review these terms.
  • One account per person. Sharing accounts is not permitted.

4. Free trial and billing

  • Free accounts receive 5 AI actions per day (messages, marking, tests) for the first 7 days after signup, then 3 AI actions per day, with limited features.
  • Full access requires a paid subscription. Pricing is displayed at sign-up.
  • Subscriptions auto-renew monthly. You may cancel at any time via Settings → Billing. Cancellation takes effect at the end of the current billing period.
  • Payments are processed by Stripe. We do not store payment card details.
  • Prices may change. We will provide at least 14 days' notice of any price increase via email.

5. Refunds

If you experience a technical issue that prevents use of the service, contact us within 7 days and we will review refund requests on a case-by-case basis. General change-of-mind refunds are not provided after a billing period has begun.

6. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose.
  • Submit content that is abusive, offensive, or violates third-party rights.
  • Attempt to reverse-engineer, scrape, or extract proprietary data from the service.
  • Share your account or sell access to others.
  • Attempt to circumvent usage limits, billing, or rate limiting.
  • Submit exam questions or content that you are not authorised to share (e.g. confidential SAC materials in breach of your school's academic integrity policy).

7. AI-generated content

AI responses are generated by large language models and may contain errors. StudyDesign AI is a study aid. It is not a substitute for your teacher, official VCAA materials, or your own judgment. Always verify important information against official sources. We are not responsible for outcomes resulting from reliance on AI-generated content.

8. Intellectual property

You retain ownership of content you submit (your questions, answers, and uploaded files). By submitting content, you grant us a limited licence to process it to deliver the service. We retain ownership of the platform, its design, and any AI-generated content produced by the service.

9. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for losses caused by downtime.

10. Limitation of liability

To the maximum extent permitted by Australian law, StudyDesign AI and its operator are not liable for any indirect, incidental, or consequential damages arising from use of the service. Our total liability is limited to the amount you paid us in the 3 months preceding the claim.

11. Termination

We may suspend or terminate accounts that violate these terms, with or without notice. You may close your account at any time via Settings or by emailing us.

12. Governing law

These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

13. Changes to these terms

We may update these terms. We will notify you of material changes via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
