Terms of Service

1. Acceptance

By creating an account or using StudyDesign AI, you agree to these Terms of Service. If you do not agree, do not use the service. These terms form a binding agreement between you and the operator of StudyDesign AI.

2. The service

StudyDesign AI is an AI-powered tutoring platform for Year 11 and 12 students in Australia. Features include an AI tutor, practice test generation, answer marking, flashcards, voice mode, and study scheduling based on published exam timetables.

StudyDesign AI is an independent product. It is not affiliated with, endorsed by, or officially connected to the Victorian Curriculum and Assessment Authority (VCAA), the NSW Education Standards Authority (NESA), the Queensland Curriculum and Assessment Authority (QCAA), the School Curriculum and Standards Authority (SCSA), the SACE Board, or any other assessment authority. Names such as VCE, HSC, QCE, WACE and SACE are used only to say which course a feature is for. Where we draw on official study designs, syllabuses or past papers, they remain the property of their owners.

3. Accounts

  • You must provide a valid email address and keep your login credentials secure.
  • You are responsible for all activity on your account.
  • You must be at least 13 years old to create an account.
  • If you are under 18, please check with a parent or guardian before you start a paid plan or a free trial. A paid plan is an agreement with the person whose card is charged, so use your own card only if you are allowed to, or ask a parent or guardian to pay.
  • One account per person. Sharing accounts is not permitted.

4. Free plan, free trial and billing

  • Free plan. You can use StudyDesign AI without paying. The free plan has daily and lifetime limits and some features are locked. The limits are shown in the app and may change.
  • Free trial. Some paid plans start with a 3-day free trial. A trial needs a payment card. You are not charged during the trial. The trial, and the price that will be charged after it, are shown before you enter your card details.
  • When the trial ends. Unless you cancel before the trial ends, your card is charged automatically for the plan you chose (for example A$9.99 per month for Student), and the plan then renews each billing period at that price until you cancel. We will also email you about 12 hours before the trial ends, but that email is a courtesy. Check the trial end date in Settings and cancel before it if you do not want to be charged.
  • Cancelling. You can cancel at any time in Settings under Manage subscription. There is no cancellation fee. If you cancel during the trial you will not be charged. If you cancel a paid plan you keep access until the end of the period you have already paid for.
  • Prices are in Australian dollars and include GST where GST applies. There are no extra fees at checkout.
  • Payments are processed by Stripe. We do not store payment card details.
  • If we raise a price, we will email you at least 14 days beforehand. You can cancel before the new price applies.

5. Refunds and your consumer rights

Our services come with guarantees under the Australian Consumer Law that cannot be excluded. If the service is not provided with due care and skill, or does not do what we said it would, you may be entitled to a remedy such as a refund or compensation, and these terms do not limit that.

Beyond those rights: if a technical fault stops you using the service, or you were charged when you did not expect to be (for example you forgot to cancel a trial), email us within 14 days of the charge and we will look at refunding it. Otherwise we do not refund a billing period that has already started for change of mind.

6. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose.
  • Submit content that is abusive, offensive, or violates third-party rights.
  • Attempt to reverse-engineer, scrape, or extract proprietary data from the service.
  • Share your account or sell access to others.
  • Attempt to circumvent usage limits, billing, or rate limiting.
  • Submit exam questions or content that you are not authorised to share (e.g. confidential SAC materials in breach of your school's academic integrity policy).

7. AI-generated content and academic integrity

AI responses are generated by large language models and can be wrong. StudyDesign AI is a study aid. It is not a substitute for your teacher or for official materials from your assessment authority, so check anything important against them.

Marks and grades from StudyDesign AI are estimates to help you practise. They are not official marks, they may differ from what your teacher or an examiner would give, and they do not predict your final result or ATAR.

Use StudyDesign AI to learn, not to produce work that is meant to be your own. Do not hand in AI-generated text for assessed tasks unless your school allows it. Following your school academic integrity rules is your responsibility.

8. Intellectual property

You retain ownership of content you submit (your questions, answers, and uploaded files). By submitting content, you grant us a limited licence to process it to deliver the service. We retain ownership of the platform, its design, and any AI-generated content produced by the service.

9. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. Subject to section 10, we are not liable for losses caused by downtime.

10. Limitation of liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Subject to that, and as far as the law allows, we are not liable for indirect or consequential loss. Where we are liable for breaching a consumer guarantee and the law lets us limit our liability, we limit it to resupplying the service or paying the cost of resupplying it.

11. Termination

We may suspend or close an account that breaks these terms, and we will tell you why where we reasonably can. If we close a paid account for a reason other than breaking these terms, we will refund the unused part of the period you paid for. You may close your account at any time via Settings or by emailing us.

12. Governing law

These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

13. Changes to these terms

We may update these terms. We will notify you of material changes via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
